1. About myKafeel.org
myKafeel.org (“myKafeel,” “we,” “our” or “us”) is a charitable crowdfunding platform that connects individual donors (“Sponsors” or “Kafeels”) with deserving students in Pakistan who need financial support to access education. By using this website you agree to be bound by these Terms & Conditions.
If you do not agree with any part of these Terms, please discontinue use of the website immediately.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract to register a child, sponsor a child, or make a donation through myKafeel.org. By using the platform you represent and warrant that you meet these requirements.
3. Nature of Donations
All contributions made through myKafeel.org are voluntary, non-refundable gifts intended to fund the educational expenses of the listed students. myKafeel.org is not a savings, investment, or lending platform and donors should not expect any financial return.
Donations made through myKafeel.org are not tax deductible. myKafeel.org does not issue tax-exemption receipts and contributions cannot be claimed as a charitable deduction in any jurisdiction. If a tax-deductible donation is important to you, please consult a registered tax-exempt charity in your country.
Sponsorship of a child does not create any legal guardianship, custodial, employment, or contractual relationship between the Sponsor and the child or the child's family.
4. Use of Donations
Donations received are used to cover the recipient student's education-related costs, which may include but are not limited to:
- School tuition and registration fees
- Textbooks, stationery, and learning materials
- School uniforms and shoes
- Transport to and from school
- Examination fees and certification costs
Where a particular child becomes ineligible (for example, due to relocation, withdrawal from school, or no longer requiring support), myKafeel.org reserves the right to reallocate the donation to another deserving student with a comparable need.
5. Registration of a Child
Parents, guardians, or accredited representatives may submit an application on behalf of a child through our registration form. By submitting an application you confirm that:
- You are the parent, legal guardian, or authorised representative of the child.
- All information provided is accurate, complete, and submitted in good faith.
- You consent to myKafeel.org displaying the child's name, photograph (if provided), grade, location, and story on the public website for the purpose of finding a sponsor.
- You will promptly inform myKafeel.org of any change in the child's circumstances.
Applications are subject to verification. myKafeel.org reserves the sole right to accept, reject, or remove any application without obligation to provide a reason.
6. Verification & Transparency
myKafeel.org takes reasonable steps to verify each application — including reviewing supporting documents such as school fee invoices, attendance records, and family income evidence. However, we cannot warrant the absolute accuracy of every detail provided by applicants. Sponsors acknowledge that contributions are made on a best-efforts basis.
We endeavour to share periodic updates on sponsored children, including academic progress, where appropriate and where the child's family has consented.
7. Payments
Donations may be processed by third-party payment providers (including but not limited to Stripe). By making a donation you agree to the terms and privacy policies of those providers. myKafeel.org is not liable for any failure, delay, or error caused by payment-processor systems.
Currency conversion rates, processing fees, and bank charges are determined by the payment provider and are deducted from your contribution before reaching the platform.
8. Refund Policy
As donations are voluntary contributions toward a charitable cause, they are generally non-refundable. Refund requests submitted in writing within 14 days of payment may be considered at our sole discretion, provided that the funds have not yet been disbursed to the recipient.
Refunds, if approved, will be made to the original payment method and may be subject to a deduction equal to the non-recoverable processing fees charged by the payment provider.
9. Recurring Sponsorships
Sponsors who commit to a monthly contribution agree to maintain support for a minimum of twelve (12) months, in alignment with the academic year. You may cancel a recurring sponsorship at any time by contacting salam@mykafeel.org; cancellations take effect after the current billing cycle.
10. Privacy & Use of Personal Data
We collect personal information from Sponsors and applicants solely for the purpose of operating the platform, processing donations, verifying applications, and providing updates. We do not sell or share personal data with unrelated third parties.
Photographs and stories of sponsored children are used to promote the cause of education in Pakistan. Parents or guardians may request the removal of a child's information at any time by writing to us.
11. Intellectual Property
All content on myKafeel.org — including text, graphics, logos, photographs, and software — is the property of myKafeel.org or its contributors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content for commercial purposes without prior written permission.
12. User Conduct
You agree not to use the platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the website. You further agree not to:
- Submit false, misleading, or fraudulent applications;
- Attempt to contact a sponsored child or their family outside the platform without consent from myKafeel.org;
- Use the platform to solicit donations for purposes outside its stated mission;
- Upload any content that is defamatory, obscene, or violates the rights of any third party.
13. Limitation of Liability
myKafeel.org provides the platform on an “as is” and “as available” basis. To the maximum extent permitted by law, myKafeel.org disclaims all warranties, express or implied. We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform or from any donation made.
14. Indemnification
You agree to indemnify and hold harmless myKafeel.org, its directors, employees, volunteers, and affiliates from any claim, loss, damage, or expense arising out of your use of the platform, your violation of these Terms, or your infringement of any rights of a third party.
15. Changes to These Terms
We may revise these Terms from time to time. The latest version will always be available on this page with an updated “last updated” date. Continued use of the platform after a revision constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States of America and the State of New Jersey, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of New Jersey.
